Terms and Conditions for UAE AI Trading Assistant

OKX Middle East Fintech FZE ("OKX")is regulated by the Virtual Assets Regulatory Authority (VARA) of Dubai. OKX holds a VASP Licence for VA Lending and Borrowing Services, VA Management and Investment Services, VA Exchange Services, and VA Broker-Dealer Services.

The UAE AI Trading Assistant ( the "Chatbot" or "Service") is offered by OKX.
These Terms and Conditions shall supplement our UAE Terms of Service. In the event of any conflict or inconsistency of any term or provision set forth in these Terms and Conditions and our UAE Terms of Service, such conflict or inconsistency shall be resolved by giving precedence first to these Terms and Conditions.
You are advised that Virtual Assets are not subject to any form of deposit protection or insurance under the laws of the UAE.
By accessing the Service, you are deemed to have read, understood, and agreed to be bound by these Terms and Conditions.

1. Service Nature and Disclaimers

The Chatbot is an automated assistance program designed to help you request, review, and confirm price quotations for an OTC trade. The Chatbot allows you to access market data and general platform guidance to execute an OTC trade to facilitate communication and price negotiation, but it does not independently complete, authorize, or guarantee any transaction.
The Chatbot utilises Artificial Intelligence (AI) and Machine Learning models. While designed for accuracy, AI may produce "hallucinations" or inaccurate market information. You must independently verify all data before authorising any transaction(s). The Service is an automated tool; you acknowledge that the logic used by the algorithm may have inherent biases or data assumptions that could affect output.
Quotes are time-limited and subject to market volatility; execution at the quoted price is not guaranteed.
The Chatbot may suggest, notify, or redirect you to fund or top up your account when needed to complete trading actions; these prompts are available actions and do not constitute investment, financial, tax, or legal advice.
There are platform limitations on the maximum size of the trades. Please pay close attention to the user interface for the applicable order limit. Some orders may be partially executed or not fully filled due to technical constraints, liquidity availability, market conditions, or system limitations; partial execution does not constitute a system failure and may result in multiple fills at varying prices. The Chatbot does not independently execute trades unless you explicitly authorize such actions through platform workflows.
All information provided by the Chatbot is for informational and educational purposes and does not constitute investment, trading, financial, tax, legal, or accounting advice. The Chatbot does not act as a fiduciary, advisor, or professional consultant; you are solely responsible for verifying all information and making independent trading decisions.
The Chatbot may generate incorrect, incomplete, outdated, or inaccurate market or order information, and may produce AI hallucinations; no guarantees are given regarding the accuracy, completeness, or reliability of any output. You should independently confirm all market information before acting on it.

2. Fees and Costs

Trading via the platform remains subject to all applicable trading fees and markup. OKX reserves the right to charge you fees for providing the Service to you ("Service Fees"). In the event OKX charges Service Fees, you agree to pay all applicable Service Fees for accessing and/or using the Service.
Updates to fees may occur at any time, and you are responsible for reviewing fee schedules before placing orders.

3. Client Protection and Risk Disclosure

Market Risks: Virtual assets involve high risk and significant volatility. Past performance does not guarantee future results.
Human Oversight: OKX maintains human-in-the-loop controls and a "kill-switch" mechanism to pause the Service in the event of market anomalies or technical errors.
Complaint Handling: You may register complaints regarding the Service through our dedicated portal at here. All complaints will be handled in accordance with VARA-mandated procedures.

4. Data Privacy and Governance

Certain chat interactions, device identifiers, usage analytics, trading actions following Chatbot interactions, and account/funding activities may be collected to improve the Service, enhance security, satisfy compliance obligations under the UAE Data Protection Law and our Privacy Notice, and personalize the user experience.
All data collection and use is governed by Privacy Notice, which is incorporated into these Terms. By using the Service, you acknowledge that you have read and accepted the Privacy Notice.
All AI decision logs and interaction data are retained for a minimum of 2 (two) years for regulatory audit purposes.
In the event of market anomalies, flash crashes, liquidity failures, technical errors, faulty price feeds, or system malfunctions, OKX may pause trading, reverse orders, cancel transactions, adjust account balances, or take any action necessary to maintain orderly markets.
Users must not rely solely on the Chatbot for decision-making, must comply with applicable laws, must avoid providing inaccurate information, and must safeguard their credentials.

5. General

Market Manipulation: You are strictly prohibited from using the Chatbot to engage in wash trading, self-dealing, or any activity that gives false or misleading signals as to the supply, demand, or price of a Virtual Asset. Such actions constitute a "Market Offence" under VARA Regulations and will result in immediate termination of access.
No Rehypothecation: Unless explicitly agreed in a separate agreement, OKX will not use, lend, or rehypotheicate any Virtual Assets held in your account for its own benefit.
The Chatbot is provided “as is” and “as available” without warranties of any kind, whether express or implied.
To the fullest extent permitted by law, OKX is not liable for any indirect, incidental, consequential, or special damages, and total liability is limited to the fees paid for the transaction giving rise to the claim. OKX is not liable for any losses, including financial losses, arising from reliance on any Chatbot-generated content.
This Service is not (i) investment advice or an investment recommendation; (ii) an offer or solicitation, buy or sell crypto/digital assets; or (iii) financial, accounting, legal or tax advice. You should carefully consider whether trading or holding crypto/digital assets is suitable for you in light of your financial condition and risk tolerance. Please consult your legal/ tax/ investment professional for questions about your specific circumstances. Crypto/digital assets, including stablecoins and NFTs, are subject to market volatility, involve a high degree of risk, can lose value. Historical returns are not indicative of future returns and past performance is not indicative of future results. OKX is not responsible for any potential losses. Not all products offered in all regions and this activity may be limited or not offered in some markets. Please consult your legal/ tax/ investment professional for questions about your specific circumstances.
OKX reserves the right to monitor participant behavior during the event and to disqualify any user it deems to have engaged in fraudulent, abusive, or otherwise irregular conduct. Prohibited conduct includes, but is not limited to: registering multiple accounts, using accounts or personal information belonging to others, submitting falsified KYC documentation, manipulating trading volume, engaging in wash trading or self-dealing, repeatedly recycling on-chain funds, participating in reward farming groups, or any other illegal, deceptive, or harmful activities. OKX reserves the right to revoke a participant’s eligibility without prior notice in the event of any such conduct.

6. Amendments

OKX reserves the right to interpret the terms and conditions of this Service as it sees fit. It reserves the right to modify these terms and conditions at any time, exclude any participants from this Service, and/or cancel this Service without notice. Your continued use of the Service constitutes acceptance of the updated Terms.

7. Governing Law and Juridiction

Governing Law: These terms and conditions, and any non-contractual obligations arising out of or in connection with them, shall be governed by and construed in accordance with the laws of England and Wales.
Jurisdiction: You acknowledge and agree that in the event of any dispute or controversy, difference or claim including the existence, validity, interpretation, performance, breach or termination of these terms and conditions, or any dispute arising out of or relating to these terms and conditions in any manner whatsoever, the jurisdiction set out in our UAE Terms of Service, shall apply.

If there is a discrepancy between the English version of these Terms and Conditions and the translation of other languages version, the English version shall prevail.
